1. Acceptance of Terms
By accessing or using InstantASMR ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.
2. Service Description
InstantASMR provides two types of services:
- Instant Video Calls: Real-time video sessions with ASMR artists, billed per minute
- Scheduled Sessions: Pre-booked video sessions at a fixed price
3. Prepaid Credits System
3.1 Credits Overview
Credits are the exclusive payment method for instant video calls. Scheduled sessions use direct payment.
3.2 Purchasing Credits
- Credits can be purchased in fixed amounts ($20, $50, $100) via PayPal
- Credits are added to your account immediately upon successful payment
- 1 credit = $1.00 USD
- Guest users can purchase credits by providing an email address
- Registered users' credits are tied to their account
3.3 No Refunds Policy
IMPORTANT: All credit purchases are final and non-refundable.
- Credits have no cash value and cannot be converted to currency
- Credits cannot be transferred between users
- Credits cannot be refunded for any reason, including:
- Change of mind
- Unused credits
- Account closure
- Technical difficulties on your end (poor internet, device issues)
- Dissatisfaction with service quality
3.4 Credit Expiration
- Credits expire one year from the date of purchase
- Expired credits are automatically removed from your account with no refund
- You will receive email notifications 30 days and 7 days before expiration
The Platform may issue credits (not cash refunds) in the following cases:
- Artist cancels your session
- Technical issues on the Platform's end
- Session interrupted due to Platform malfunction
- Double-booking or slot conflict
Platform-issued credit refunds are at InstantASMR's sole discretion.
4. Instant Video Calls
4.1 Billing Structure
- Artists set their own per-minute rates ($1.50 - $5.00 per minute)
- 5-Minute Minimum: All instant calls are charged for a minimum of 5 minutes, regardless of actual call duration
- Billing begins when both parties (customer and artist) join the video room
- After the first 5 minutes, billing continues per minute until the call ends
4.2 Credit Deduction
- The full 5-minute minimum charge is deducted immediately when both parties join
- Additional per-minute charges are deducted in real-time as the call continues
- If your credit balance reaches $0, the call automatically ends
4.3 Customer Disconnect Before 5 Minutes
If you disconnect before the 5-minute minimum has elapsed:
- Billing continues for the full 5 minutes
- You will be charged the complete 5-minute minimum
- The artist must remain available for the full 5 minutes to receive payment
- No refunds or credits are issued for early customer disconnect
4.4 Artist Disconnect
If the artist disconnects during your call:
- Billing is immediately paused
- The artist has a 2-minute window to reconnect
- If the artist reconnects within 2 minutes, billing resumes
- If the artist does not reconnect:
- You will be charged only for actual call time (artist present time)
- A credit refund will be issued for the difference between the 5-minute minimum and actual time
- Example: Artist present for 2 minutes → charged $4 (2 min), refunded $6 (3 min)
4.5 In-Call Credit Reload
- You can reload credits during an active call without disconnecting
- The call continues while you complete the PayPal payment
- If payment is not completed before credits reach $0, the call ends
4.6 Connection Quality
InstantASMR is not responsible for:
- Poor internet connection on your end
- Device compatibility issues
- Browser issues or unsupported browsers
- Audio/video quality problems caused by your setup
- Calls dropped due to your network issues
No refunds or credits are issued for connection problems originating from your side.
5. Scheduled Sessions
5.1 Booking and Payment
- Scheduled sessions are paid in full at time of booking via PayPal
- Payment is final once the session is confirmed
- No slot is reserved until payment is confirmed
5.2 Cancellation Policy - Customers
Cancellation refunds are issued as credits only (not cash):
- 48+ hours before session: 100% credit refund
- 24-48 hours before session: 50% credit refund
- Less than 24 hours before session: 0% credit refund
5.3 Cancellation Policy - Artists
If an artist cancels your scheduled session:
- You receive a 100% credit refund, regardless of timing
- The artist may be penalized based on cancellation timing:
- 48+ hours before: No penalty
- 24-48 hours before: 10% of booking price
- Less than 24 hours: 25% of booking price
6. Age Requirements
You must be at least 18 years old to use InstantASMR, whether as a customer or artist.
7. Privacy and Recording
7.1 No Recording Policy
- InstantASMR does not record any video or audio from sessions
- Recording sessions without explicit consent from all parties is prohibited
- Violating this policy may result in immediate account termination
7.2 Event Logs
- The Platform logs session metadata (join times, leave times, duration, billing events)
- These logs are used solely for billing accuracy and dispute resolution
- Logs are retained for 2 years
8. Acceptable Use
8.1 Prohibited Activities
You may not:
- Use the Platform for any illegal activities
- Harass, abuse, threaten, or intimidate artists or other users
- Request or engage in sexual content or services
- Share personal contact information to circumvent Platform fees
- Create multiple accounts to abuse promotions or credits
- Use VPNs or location spoofing to manipulate pricing or availability
- Record sessions without explicit written consent
- Impersonate another person or entity
- Attempt to hack, disrupt, or reverse-engineer the Platform
8.2 Artists: Professional Conduct
Artists must:
- Maintain a professional, respectful demeanor
- Provide services as advertised (triggers, session style, etc.)
- Be present for the full scheduled session duration
- Not solicit tips or payments outside the Platform
- Not share customer information with third parties
8.3 Acceptance Rate (Artists)
- Artists who miss or decline 2 consecutive instant call requests will be automatically taken offline
- Consistent low acceptance rates may result in reduced visibility or account review
9. Disputes and Refunds
9.1 Dispute Process
If you experience an issue during a session:
- Contact support at support@instantasmr.com within 48 hours
- Provide your booking/call ID and a detailed description
- Include screenshots or evidence if applicable
- InstantASMR reviews all disputes based on event logs and user reports
- Our decision regarding refunds or credits is final and binding
- We reserve the right to deny refunds if evidence does not support the claim
9.3 No Cash Refunds
All refunds are issued as credits only. We do not issue cash refunds under any circumstances.
10. Account Termination
10.1 Termination by User
- You may close your account at any time
- Unused credits are forfeited upon account closure (no refunds)
- Scheduled sessions must be cancelled before account closure
InstantASMR may suspend or terminate your account for violation of these Terms, fraudulent activity, or abusive behavior.
10.3 Effect of Termination
Upon termination, all unused credits are forfeited with no refund.
11. Payment Processing
- Payments are processed via PayPal (and PayFast for South Africa)
- You agree to the payment processor's terms and conditions
- Chargebacks may result in immediate account suspension
- Instant calls: 25% platform fee (artist receives 75%)
- Scheduled sessions: 25% platform fee (artist receives 75%)
- Artists are paid weekly for completed sessions
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- InstantASMR is provided "as is" without warranties
- We are not liable for damages arising from your use
- Our total liability shall not exceed the amount you paid in the last 3 months
- We are not responsible for artist conduct, session quality, or connection issues
14. Changes to Terms
We may update these Terms at any time. Continued use after changes constitutes acceptance.
